Eduardo J. Valdes has been practicing in the area of general litigation, including insurance defense and commercial litigation since 2003. His practice includes general association representation, as well as construction defect litigation and insurance defense. In his association representation, he has personally handled a wide range of litigation matters, including developer transition claims, contract disputes, enforcement of declaration/bylaws/rules by injunction actions, financial mismanagement claims, directors and officers liability defense, commercial lease disputes, employment grievances, constitutional issues, assessment collection, easement disputes, and mixed use development disputes. In addition, Mr. Valdes has prepared condominium documents for associations, negotiated and documented condominium loans for associations, prepared and negotiated vendor contracts, drafted amendments to association declarations, bylaws, articles of incorporations and rules and regulations, assisted in election procedures and administration, and counseled innumerable clients on condominium and/or corporate issues. Mr. Valdes has extensive experience defending associations from actions brought before the Florida Department of Business and Professional Regulation, as well as building code and fire code violations brought before local municipalities. His experience spans many aspects of the construction industry having worked with various aspects of construction projects with a deep understanding of the issues relevant to owners, contractors, developers, architects, insurance companies and other players in this industry. He handles matters in mediation, arbitration and litigation and has been involved in virtually every kind of claim or dispute related to a construction project, including construction defect claims, claims for delay and/or disruption and developer, general contractor/subcontractor liability claims and architect and engineering professional liability claims.
